1. Agreement to Terms

By accessing and using the services provided by Accurate Solutions, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your relationship with Accurate Solutions ("us", "we", or "our") when using our IT support, Smart Hands support, and related technology services.

2. Service Description

Accurate Solutions provides professional IT support and technology services including but not limited to:

  • Smart Hands Support services
  • Remote IT support and troubleshooting
  • On-site technical assistance
  • Network management and maintenance
  • Office fit-out and technology setup
  • Emergency IT support services
  • System monitoring and maintenance

3. Service Availability

We strive to provide reliable and consistent services, however:

  • Services may be temporarily unavailable due to maintenance, updates, or technical issues
  • We do not guarantee 100% uptime for all services
  • Emergency support is available 24/7 for critical issues
  • Standard support is provided during business hours (Monday-Friday, 8:00 AM - 6:00 PM)

Service Level Commitments:

  • Emergency response within 4 hours for critical issues
  • Standard support tickets resolved within 24-48 hours
  • Planned maintenance notifications provided 48 hours in advance

4. User Responsibilities

As a client of our services, you agree to:

  1. Provide Accurate Information: Supply correct and complete information when requesting services
  2. Maintain Security: Keep your systems and credentials secure
  3. Backup Data: Maintain regular backups of critical data
  4. Notify Issues: Report problems or security incidents promptly
  5. Compliance: Ensure your systems comply with applicable laws and regulations
  6. Access: Provide necessary access for our technicians to perform services

5. Payment Terms

Our payment terms are as follows:

  • Services are billed according to agreed-upon rates and schedules
  • Payment is due within 30 days of invoice date unless otherwise agreed
  • Late payment may result in service suspension
  • Emergency call-out fees may apply for after-hours support
  • Travel costs may be charged separately for on-site services

Important Payment Information:

Unpaid invoices beyond 60 days may result in suspension of services and may be referred to collection agencies. Interest charges may apply to overdue accounts.

6. Limitation of Liability

To the maximum extent permitted by law:

  • Our liability is limited to the amount paid for services in the 12 months preceding the claim
  • We are not liable for indirect, consequential, or punitive damages
  • We are not responsible for data loss unless caused by our gross negligence
  • Force majeure events (natural disasters, government actions, etc.) excuse performance delays

Data Protection Notice:

While we implement industry-standard security measures, you are responsible for maintaining backups of your critical data. We strongly recommend regular backup procedures independent of our services.

7. Confidentiality

We understand the sensitive nature of your business information and commit to:

  • Maintaining strict confidentiality of all client information
  • Using information only for the purpose of providing services
  • Implementing appropriate security measures to protect data
  • Not disclosing information to third parties without consent
  • Returning or destroying confidential information upon request

8. Intellectual Property

Regarding intellectual property rights:

  • You retain ownership of your data and business information
  • We retain ownership of our proprietary tools, methods, and documentation
  • Any custom solutions developed remain our intellectual property unless otherwise agreed
  • You grant us license to use your data solely for providing contracted services

9. Termination

This agreement may be terminated:

  • By either party with 30 days written notice
  • Immediately for material breach of terms
  • Immediately for non-payment of invoices
  • Upon completion of project-based services

Upon termination:

  • All outstanding invoices become immediately due
  • We will assist with orderly transition of services
  • Confidential information will be returned or securely destroyed
  • Access to our systems and services will be revoked

10. Dispute Resolution

In the event of disputes:

  1. We encourage direct communication to resolve issues amicably
  2. Formal complaints should be submitted in writing
  3. Mediation will be attempted before legal proceedings
  4. South African law governs this agreement
  5. Johannesburg courts have exclusive jurisdiction

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.

For significant changes affecting existing contracts, we will provide 30 days advance notice via email.

12. General Provisions

  • Severability: If any provision is deemed invalid, the remainder remains in effect
  • Entire Agreement: These terms constitute the complete agreement unless superseded by written contract
  • Assignment: You may not assign this agreement without our written consent
  • Waiver: Failure to enforce any provision does not constitute waiver
  • Headings: Section headings are for convenience only
